Protocole

Notice of a case management conference

In order to expedite judicial process, the Court of Québec Civil Division and the Montreal Bar encourage the use of case management by sending a Notice of a case management conference under the terms of Article 4.1 of the Code of Civil Procedure.

WARNING: This notice must be served to the parties and filed within the usual time periods (Article 78 C.C.P.). It must concisely present the specific elements that the court will be asked to manage, e.g. incidental motions, examinations and documents to be filed before examination, as well as a reasonable estimate of the time required for the completion of the record. Please note that the management conference under Article 4.1 of the Code of Civil Procedure may not be used to debate objections resulting from an examination. Likewise, this procedure differs from the one present at Article 151.11 of the Code of Civil Procedure relating to special case management based on the power of the Chief Justice to designate a judge to see to the orderly conduct of the proceeding.
